These Terms & Conditions apply to all vehicle rentals provided by Creta Machine Club (the “Company”) and form part of the rental agreement between the Company and the renter/driver (“Customer”). By making a reservation, paying any amount, or collecting the vehicle, the Customer confirms that they have read, understood, and accepted these Terms & Conditions.
1. General Vehicle Use
1.1 Asphalt Roads Only
All rented vehicles may be used only on asphalt (paved) roads and in full compliance with Greek traffic law.
1.2 Strict Prohibition of Off-Road Use
Off-road use is strictly prohibited for all vehicle types, including but not limited to: dirt roads, beaches, sand roads, fields, mountain paths, rocky tracks, rural tracks, and any road that is not officially paved and properly maintained.
1.3 Consequences of Off-Road Use
Use of the vehicle on dirt roads, beaches, fields, mountain paths, or any non-asphalt surface constitutes a material breach of this agreement.
Such use:
Automatically voids all insurance coverage.
Triggers a Company penalty of €50–€100, depending on circumstances.
Makes the Customer fully responsible for all direct and indirect damages, including recovery and loss of rental income.
1.4 Misuse and Negligence
Any damage resulting from misuse, negligence, or violation of these Terms is not considered normal wear. Damage caused willfully, recklessly, or through improper use of the vehicle is not covered by any insurance.
2. Highway / National Road Use
2.1 Highway Prohibited (National Road Not Allowed)
Use of the national road/highway is not allowed for:
Scooters 50cc – 100cc
Quads (ATV) 50cc – 400cc
Buggies 200cc – 500cc
2.2 Highway Allowed
Highway use is permitted for:
Scooters 125cc and above
Quads (ATV) 450cc and above
Buggies 1000cc and above
All cars and motorcycles
2.3 Customer Responsibility
The Customer is responsible for knowing whether highway use is permitted for the rented vehicle category. Any violation of highway restrictions voids insurance coverage and transfers full liability to the Customer.
3. Passengers & Authorized Drivers
3.1 Passengers
scooters, quads, and buggies are limited to two (2) persons maximum.
Cars may carry passengers only according to the manufacturer’s stated seating capacity.
Exceeding passenger limits voids insurance and results in full Customer liability.
3.2 Authorized Drivers
The vehicle may be driven only by the driver(s) listed in the rental agreement. Use by any third party automatically voids insurance and transfers full liability to the Customer.
4. Area & Distance Restrictions (Insurance Validity)
Insurance coverage is valid only within the approved distance and usage area defined below, measured from the rental office in Stalis, regardless of any selected insurance package.
4.1 Limited Area – 25 km
Applies to:
Scooters 50cc – 100cc
Quads 50cc – 400cc
Buggies 200cc – 500cc
Highway use is not allowed.
4.2 Extended Area – 35 km
Applies to:
Scooters 125cc and above
Quads 450cc and above
Buggies 1000cc and above
Coverage includes Heraklion, Lasithi Plateau, and Agios Nikolaos. Highway use is allowed.
4.3 Full Crete Coverage
Applies to: Cars and motorcycles
Travel is allowed throughout Crete, asphalt roads only.
5. Leaving Crete
It is strictly forbidden to take any rented vehicle outside the island of Crete. Any violation immediately voids insurance and results in full Customer liability for any loss, damage, recovery costs, legal costs, and loss of use.
6. Mileage Policy
All rentals include UNLIMITED KILOMETERS FREE OF CHARGE, within the usage area and restrictions defined above. Unlimited mileage does not override any area, road, or usage limitations.
7. Driver Requirements & Driving License
7.1 Minimum Age & License Validity
The driver must:
be at least 18 years old, or higher if required by law or vehicle category,
hold a valid driving license suitable for the rented vehicle,
present the original driving license before rental.
7.2 Invalid or Incorrect License
If the driving license is invalid, inappropriate, expired, damaged, or falsely declared, the rental is considered void, insurance is cancelled, and the Customer remains fully liable.
7.3 Right to Refuse Rental
The Company reserves the right to refuse or cancel the rental if the driving license, documents, or driver behavior is considered unsuitable for the rented vehicle category. The Company may request additional identification or documentation if required.
8. Traffic Fines, Violations & Tolls
All traffic violations, parking tickets, fines, tolls, or penalties incurred during the rental period are entirely the Customer’s responsibility, even if received after the vehicle is returned. The Customer must inform the Company of any traffic violation or fine received during the rental period. The Company reserves the right to charge:
the full amount of the fine/violation, and any applicable administrative handling fee as permitted by law.
9. Vehicle Condition – Cleaning – Smoking
9.1 Vehicle Condition
The Customer confirms the vehicle is received in good and clean condition and agrees to return it in the same condition, excluding normal wear as determined by the Company.
9.2 Additional Charges
Additional charges may apply for:
excessive dirt or interior cleaning,
smoking inside the vehicle,
damage to interior or exterior,
missing or damaged equipment (keys, helmets, accessories).
Replacement cost may include towing, recovery, or delivery costs if applicable.
9.3 Customer Duty of Care
The Customer is responsible for securing and safely parking the vehicle at all times. Damages or theft resulting from negligence, improper parking, or failure to secure the vehicle are not covered by insurance.
10. Reservations, Rental Period, Late Return & Refund Policy
10.1 Rental Period
The rental period is defined by the date and time stated in the booking confirmation and/or rental agreement.
10.2 Definition of Rental Day
The first rental day is valid from 09:00 until 20:00 of the same day.
Each additional rental day is calculated as a 24-hour period.
10.3 Late Return
Late return without prior approval may result in additional charges, including the charge of an extra rental day.
10.4 Reservation Cancellation Policy (72 Hours)
Vehicle rental reservations may be cancelled free of charge up to seventy-two (72) hours prior to the scheduled pickup time.
The cancellation request must be sent in writing via email to cretamachine@gmail.com. Cancellations made by telephone, WhatsApp, social media messages, or in person are not considered valid unless confirmed by email.
If the cancellation request is received less than seventy-two (72) hours before pickup, the booking becomes non-refundable.
10.5 No-Show / Late Arrival
In case of no-show, late arrival exceeding two (2) hours without prior written notice, or failure to meet rental requirements at pickup (including valid documents and payment/deposit requirements), the total rental amount remains fully payable and non-refundable.
10.6 Early Return
Early return does not entitle the Customer to any refund for unused rental days.
10.7 Failure to Return
Failure to return the vehicle may be reported to the authorities. The Company reserves the right to take all necessary legal actions to recover the vehicle and any related costs.
10.8 Vehicle Substitution
The Company reserves the right to substitute the rented vehicle with a similar or higher category vehicle, if necessary.
11. Fuel Policy
Fuel is the Customer’s responsibility. The vehicle is delivered with a specific fuel level and must be returned with the same fuel level. If returned with less fuel:
the missing fuel will be charged to the Customer, and a refueling service fee may apply.
No refunds are given for excess fuel at return.
12. Accident – Damage – Breakdown Procedure
In case of accident, damage, theft, or mechanical breakdown, the Customer must:
immediately inform the Company, remain at the scene at all times unless personal safety is at risk, not leave the location unless required for safety or instructed by the Company.
Leaving the scene of an accident or incident automatically voids all insurance coverage. Failure to report an incident immediately results in full Customer liability. Failure to comply with this procedure results in insurance cancellation and full Customer liability.
The Company reserves the right to immediately repossess the vehicle without refund if any terms of this agreement are violated.
13. Insurance & Customer Liability
13.1 Insurance Coverage
All vehicles are covered by insurance according to the insurance level selected by the Customer, valid only if all terms and restrictions of this agreement are fully respected.
Insurance coverage applies exclusively within the approved usage area, on the permitted road network, during the rental period, and only when driven by authorized drivers.
13.2 Customer Liability
In case of accident or damage, the Customer is liable up to the maximum liability amount (excess), if applicable, as stated in the rental agreement, provided that the insurance coverage is valid. The Customer may also be charged for loss of use of the vehicle during repair or replacement time.
13.3 Cases Where Insurance Is Not Valid
No insurance coverage applies in cases of serious negligence, reckless driving, or violation of traffic laws, including but not limited to:
off-road or non-asphalt use,
violation of highway restrictions,
exceeding distance limits or leaving Crete,
driving under the influence of alcohol, drugs, or prohibited substances,
unauthorized driver use,
speeding, dangerous, or aggressive driving,
exceeding passenger limits,
leaving the scene of an accident/incident,
failing to follow required accident/breakdown procedures,
providing false or incomplete information,
violating traffic signals (red light, STOP, right of way),
illegal maneuvers, racing, stunts,
intentional damage or gross misuse.
In all such cases, the Customer bears full and exclusive financial responsibility for any loss or damage, regardless of selected insurance.
13.4 Optional Insurance Coverage
Any upgraded or additional insurance coverage is valid only if selected and fully paid, and applies strictly under the same terms and restrictions. Personal accident insurance is not included and remains the Customer’s responsibility.
14. Payments, Security Deposit & Digital Signature
14.1 Acceptance of Terms
By signing the rental agreement, the Customer confirms that:
all provided information is accurate,
the vehicle category, usage rules, and restrictions are fully understood,
these Terms & Conditions have been read and accepted.
14.2 Payments
All amounts paid by the Customer, including rental fees, insurance fees, upgrades, penalties, or additional charges, are non-refundable under the conditions stated in Section 10 (Refund Policy).
14.3 Security Deposit
The security deposit is refundable, provided that the vehicle is returned in accordance with these Terms & Conditions and without outstanding charges, damages, fines, or violations. The Company reserves the right to retain part or all of the deposit to cover any costs arising from damages, fines, missing equipment, fuel differences, cleaning fees, or any other rental-related charges.
The refund of the security deposit may take up to thirty (30) working days from the date of vehicle return, depending on bank processing times and verification of any pending charges.
14.4 Governing Law & Jurisdiction
This agreement is governed by Greek law and subject to the exclusive jurisdiction of the courts of Heraklion, Crete, Greece.
14.5 Digital Signature & Electronic Storage
This contract is valid with handwritten or digital signature and may be stored and sent electronically (PDF).
